His death Wednesday at a Florida hospital was due to heart failure, said his son-in-law, Roy Beagle.

Yet another Tea Party group has come out publicly against the “Gang of Eight” immigration bill, as TheTeaParty.net has announced its opposition to the legislation and published online an alternative plan for immigration reform.

“The granting of citizenship is the most solemn honor this country can confer,” TheTeaParty.Net founder Todd Cefaratti said in a statement obtained by Breitbart News. “It is not something that ought to be used to score political points or to win the next election.”

“Before the American people extend this gift they must be assured that verifiable border security has preeminent priority. The Senate bill currently does not have it,” he explained. “Americans will not be bullied, intimidated and steamrolled into accepting this legislation.”

“We have proposed a conservative alternative at secureamericanow.us for which we will be rallying Congressional support in the coming days.”

The group said in its release it will be briefing members of Congress on the alternative immigration reform plan in the coming days and weeks.

TheTeaParty.Net’s chief strategist Niger Innis added that he thinks the “Senate amnesty bill is a non-starter.”

“But instead of just saying we’re against something, we have put forward eight principles that we believe are the necessary pillars of an America First Immigration alternative,” Innis said. “Over the coming days we will be meeting with conservative Senate and House members about getting them to support the plan.”

“We will not be bullied by a Harry Reid-Chuck Schumer agenda that undermines the Constitution by ramming through a bill that the American people do not support,” Innis promised. “The only way to stop a bully is to confront them.”

Many other Tea Party organizations, like Tea Party Patriots, have already announced their opposition to the Gang of Eight bill. More than 150 of them banded together in recent months to sign a letter sent to members of Congress announcing their ardent opposition to the legislation.

TheTeaParty.net did not sign that letter at the time and was fighting suggestions from the office of Sen. Marco Rubio (R-FL) that it may support the legislation.

Politico previously erroneously claimed that TheTeaParty.net was among groups that had become an “ally” of the Gang of Eight. Politico later quietly edited the story after Breitbart News discovered the groups it claimed supported the bill had not expressed support for the legislation. Rather, the groups had me with Rubio’s team to get his take on the bill before they made a decision.

“We are going to hear him out, rather than rely on the liberal media interpretation of his legislation,” Innis told Breitbart News at the time. “Reports that we have agreed to support the Gang of Eight bill are utter make-believe.”

Two defendants in military sexual assault cases cannot be punitively discharged, if found guilty, because of “unlawful command influence” derived from comments made by President Barack Obama, a judge ruled in a Hawaii military court this week.

Navy Judge Cmdr. Marcus Fulton ruled during pretrial hearings in two sexual assault cases — U.S. vs. Johnson and U.S. vs. Fuentes — that comments made by Obama as commander in chief would unduly influence any potential sentencing, according to a court documents         obtained by Stars and Stripes.

On Wednesday and Thursday, Fulton approved the pretrial defense motions, which used as evidence comments that Obama made about sexual assault at a May 7 news conference.

“The bottom line is: I have no tolerance for this,” Obama said, according to an NBC News story submitted as evidence by defense attorneys in the sexual assault cases.

‘I expect consequences,” Obama added. “So I don’t just want more speeches or awareness programs or training, but ultimately folks look the other way. If we find out somebody’s engaging in this, they’ve got to be held accountable — prosecuted, stripped of their positions, court martialed, fired, dishonorably discharged. Period.”

The judge’s pretrial ruling means that if either defendant is found guilty, whether by a jury or a military judge, they cannot receive a bad conduct discharge or a dishonorable discharge. Sailors found guilty under the Uniform Code of Military Justice’s Article 120, which covers several sexual crimes including assault and rape, generally receive punitive discharges.

“A member of the public would not hear the President’s statement to be a simple admonition to hold members accountable,” Fulton stated. “A member of the public would draw the connection between the ‘dishonorable discharge’ required by the President and a punitive discharge approved by the convening authority.

“The strain on the system created by asking a convening authority to disregard [Obama’s] statement in this environment would be too much to sustain public confidence.”

The ruling sets the stage for defense attorneys to use the same arguments in sexual assault cases throughout the military.

Should other judges accept the same line of reasoning, commands would have to consider issuing lesser administrative discharges to servicemembers found guilty of sexual assault. In some cases, this could allow servicemembers found guilty of sex crimes to retain veterans benefits, according to Defense Department regulations.

“I think that as a defense attorney, I would raise this argument in virtually any [sexual assault] case I had,” said Victor Hansen, vice president of the National Institute of Military Justice and former instructor at the Army’s JAG school.

Hansen found Thursday’s ruling surprising, since judges have rejected “unlawful command influence” arguments under the logic that statements by high-level officials lose their effect as they reach the military’s lower levels.

However, in recent months there has been a lot more said — and in overly specific terms — about sexual assault by military and political leaders, Hansen noted. Obama’s call for dishonorable discharges is an example of such specificity, which begins to sound to military juries like a direct order from the commander in chief.

“This is bad lawyering on [Obama’s] advisor’s part,” Hansen said. “It’s certainly not a problem to say that sexual assault is a bad thing and we need to weed it out … that’s innocuous. It’s when they get very pointed that it’s problematic.”

Last year, Marine Corps defendants in more than 60 sexual assault cases filed unlawful command influence claims following comments by Marine Corps Commandant Gen. James Amos, according to a May 9 McClatchy Tribune news report.

In one speech, Amos declared that 80 percent of sexual assault claims were legitimate, according to the report. Judges in nearly all of the 60 disputed cases found the appearance of unlawful command influence, according to the McClatchy report.

When contacted by Stars and Stripes, Navy legal officials in Hawaii deferred comment to the officials at the Office of the Judge Advocate General in Washington, D.C.

JAG officials in Washington said they could not comment because of potential conflicts with any appeals arising from the ruling, but confirmed the court document’s authenticity. The White House had no immediate response when asked for comment.

Obama’s comments came after a Defense Department report stated that 3,374 incidents of “unwanted sexual contact” occurred during fiscal year 2012, a 6 percent increase over the prior year.

A secondary survey reported that if the 6.1 percent of women and 1.8 percent of men who said they experienced unwanted sexual contact are extrapolated to include the entire military, about 26,000 service members may have been victimized in 2012.

The reports led to heightened public and congressional scrutiny of the military’s handling of sexual assault.

On Tuesday, the Senate Armed Service Committee voted down a proposal that would have transferred authority over military sexual assault cases to independent prosecutors. Instead, committee chairman Carl Levin, D-Mich., included a clause in a markup of next year’s defense bill that would require high-level review of decisions made by commanders not to prosecute sexual assault cases.

“A member of a pro-Travyon Martin group was caught by a circuit judge trying to sneak his way onto the George Zimmerman jury in Florida, the New York Daily News reported Wednesday.

“The potential juror — identified on his Facebook page as Jerry Counelis and referred to as panelist E-7 — gave long, rambling answers about his impartiality when interviewed by attorneys, the Daily News reported.

Circuit Judge Debra Nelson asked the unemployed artist if he posted something on March 21 to the Coffee Party Progressives Facebook page, that describes itself as a group “dedicated to seeking justice for Trayvon Martin.”

“In Sanford … & I CAN tell you THIS. ‘Justice’ IS Coming!” Counelis wrote, according to the report, adding that “with the noise WE made … it couldn’t be covered up.”

As the initial stages of the George Zimmerman and Trayvon Martin case proceeds, the media are again resurrecting the issue of racism. And not too far behind are the modern day self-proclaimed civil rights leaders.

After listening to their divisive rhetoric (only to help along the administration’s tactic of divide and conquer), I couldn’t help but notice how far off the modern day civil rights leaders are from the creed of the civil rights movement in the 1960s led by Martin Luther King Jr. He was a molder of consensus to guarantee equal rights under the law for all men, “endowed by their Creator,” as the Declaration of Independence rightly states.

Let me take you back to the 1960s. Every participant in the civil rights marches was required to sign the following pledge before they could participate:

1. Meditate on teachings of Jesus daily.

2. Remember that the non-violent movement seeks justice and reconciliation, not just victory.

3. Walk & talk in the manner of love/charity, for God is love.

4. Pray daily to be used by God.

5. Sacrifice personal needs. Greed has to go out the window.

6. Observe with both friend & foe the ordinary rules of courtesy.

7. Seek to perform regular service for others and for the world.

8. Refrain from the violence of fist, tongue or heart.

9. Strive to be in good spiritual and bodily health.

10. Follow the directions of the movement and of the captain of the demonstration.

The self-made civil rights leaders of today, such as Al Sharpton and Jesse Jackson, have left out their Bibles and their morals as they debase themselves and reap nothing but mockery and reproach. Let me contrast the original pledge with the modern version of the pledge, as demonstrated by their actions:

1. Meditate on the media and anything but the teachings of Jesus.

2. Civil disobedience to just laws, through force, in hopes of an unjust victory.

3. Walk and talk in the manner of thuggery, propaganda, and racial division!

4. Play the race card at every opportunity. And if at first it doesn’t work – keep playing it.

5. Sacrifice the needs of others to insure a victory.

6. Send threats to those who disagree with you.

7. Seek to have it your way at all costs. Lie if necessary.

8. Use fear and force and the threat of retribution.

9. Strive to take from others because you want payback!

10. The goal isn’t any one case but the larger goal of political control.

Today’s modern civil rights leaders are demoralizers of the faith. They have turned civil rights into uncivil distribution of privileges, derived by the State. They have left off the Declaration of Independence, therefore throwing off freedom. Under their directives, racism is being taught to a new generation under the guise of decrying racism.

Martin Luther King Jr. condemned the “black power” movement because he knew “injustice anywhere is a threat to justice everywhere.” His point was that men were not to be judged by the color of their skin, but by the content of their character. The civil rights movement was about truth and justice, not lies and injustice.

Students at George Mason University (GMU) signed a petition early this month asking President Obama to listen in on the “private conversations” of all Fox News employees and their families.

The petition, which was circulated on GMU’s flagship campus in Fairfax, Va, near Washington D.C., by Media Research Center video reporter Dan Joseph, described the right-leaning news channel as “a threat to media integrity and an informed populace.”

“We want the to be able to legally read their private e-mails and listen in on phone conversations between Fox News employees and their associates and their families,” Joseph explained to students, asking for their support.

Reactions were mixed. While a handful of students appealed to a “the First Amendment” and the right to privacy, several described their “hate” for the news channel.

“Can you give me some time to think about this?,” asked one student before eventually providing his signature.

Another student expressed frustration that such a surveillance program would likely conflict with constitutional law.

“It’s virtually impossible but its a good cause,” she said. “I like your cause.”

In all, eleven GMU students signed the petition in about 45 minutes, according to Joseph.

On May 19, 2013, the Washington Post reported that the U.S. Department of Justice had monitored Fox News Reporter James Rosen‘s personal telephone calls and read his emails as part of an investigation into a leak.

The DOJ obtained permission through a FISA court for the wiretap after Attorney General Eric Holder personally signed a complaint naming him a “criminal co-conspirator” in the case.

Senior US officials said on Tuesday that they will enter peace talks with the Taliban at a new office in Doha “within the coming days”, in what may be a significant step towards an end to the long-running war.

Senior US officials said on Tuesday that representatives will begin formal talks with the Taliban “within a few” days at a new office in Doha, Qatar.

The Afghan Taliban opened the office to help restart talks on ending the 12-year-old war, saying it wanted a political solution that would bring about a just government and end foreign occupation.

Senior Barack Obama administration officials, speaking on condition of anonymity because they were not authorised to speak on the record, described the office opening to AP as a stepping stone to full Taliban renouncement of al Qaeda.

The officials said the US and Taliban representatives will hold bilateral meetings, then it is expected that Afghan President Hamid Karzai’s High Peace Council will follow up with its own talks a few days later.

A senior Afghan official told Reuters that talks with the High Peace Council would go ahead.

“The peace talks will certainly take place between the Taliban and the High Peace Council,” said the senior official, referring to the body created by Karzai in 2010 to broker peace with the insurgency.

Taliban representative Mohammed Naeem held a news conference from the group’s new office on Tuesday, telling reporters that the Islamist insurgency wanted good relations with Afghanistan’s neighbouring countries. The conference was broadcast live on Qatar’s al Jazeera television channel.

The Taliban had previously said that they would not countenance peace talks with the Karzai government, which they consider a stooge of the United States and other Western nations.

A man who entered a pharmacy and demanded Ritalin and Dilaudid in Bellmont, New York,  met his match Friday afternoon when the tire of his getaway car was taken out by an armed pharmacist

At first, the pharmacist handed over the drugs, but then followed the robber, who was later identified as Marc Gumpert, 43, outside. When Gumpert drew his knife and came towards him, the pharmacist then drew his revolver and fired a single shot at him.

According to a report by the Nassau County Police Department, the 34-year-old pharmacist, who has not been identified, missed the robber. The bullet ricocheted off the ground and hit the back tire of Gumpert’s 2011 Nissan Altima. He was still able to get a license plate number for the police.

A short time later, Gumpert’s car was spotted by a Nassau County Ambulance driver. He was arrested without incident and charged with first degree robbery and third degree criminal possession of a weapon, with his bail set at $250,000. The stolen pharmaceutical drugs were also recovered.

No one was injured during the incident, which also brought about support by some for concealed carry. Mary Nolan, a customer at the pharmacy, said, “He did the right thing. The pharmacist should be allowed to carry a gun.”

The pharmacist, who has a legal permit to carry the gun, apparently decided to arm himself after a recent increase in pharmacy robberies, including two high profile cases which ended in six fatalities.

Two years ago, on Father’s Day, four people were killed at a pharmacy in Medford when David Laffer, a prescription drug addict, entered the pharmacy looking for his next fix. Laffer was apprehended and is now serving a life sentence.

Only six months later, on New Year’s Eve, another prescription drug addict was looking to rob a pharmacy in Seaford. That attempted robbery ended in both an off-duty federal agent and the robber being killed.

Following the New Year’s Eve robbery attempt, Nassau County Executive, Ed Mangano stated, referring to the newest drug addiction, “It is an epidemic, prescription drug abuse. It’s worse than heroin abuse.”

 We need to spread the word about this recall.

The recall is for every Icon, Venture and Dimension rifle made through this month of June 2013, and it goes all the way back.

According to Thompson/Center, they’ve found cases where certain rifles’ safties don’t properly engage, and when the bolt is cycled, the safety switches off. These rifles still will not fire unless the trigger is pulled, they aren’t slam-firing or anything like that, but a safety that un-safes itself is a serious issue.

The press release could not be more serious. “STOP USING YOUR RIFLE AND RETURN IT TO THOMPSON/CENTER AT ONCE.”

“Because the safety of our customers is our utmost concern, we ask that you stop using your rifle until we have an opportunity to inspect the safety lever to ensure its proper function.”

Owners of Icon, Venture and Dimension rifles should contact the Thompson/Center customer service department. They will send you a pre-paid shipping label to have the rifle sent back to them at no cost to you.

Icon, Venture and Dimension rifles that have been inspected and found to have safeties that do not bind and function correctly will receive a small mark on the end of the safety lever, indicating that it has been inspected and passed.

If you’re buying one of these potentially-dangerous rifles from here on out, be sure to check the safety for the indicator to make certain that your rifle is safe. If the safety does not have the mark, be prepared to contact the Thompson/Center customer service department.

It is uncommon for a company to recall entire product lines like this, although for this particular issue it’s understandable.

The last company to issue a full recall on complete lines of their product was Caracal, after they had one case where a customer’s slide cracked at the ejection port, sending the rear half of the slide flying. Whether it was a case where one slide had a metallurgical fault or a design flaw, they pulled them all.

If you’re an owner of one of the Thompson/Center rifles that may have this problem, or you know someone who might be, make sure these guns get sent back to the factory for inspection. A safety that isn’t is a serious issue.

A congressional committee chaired by Rep. Darrell Issa, R-Calif., may have moved on to other Obama administration scandals, but Arizonans still want answers to unanswered questions about the Fast and Furious gun-running project that sent thousands of weapons to drug lords in Mexico.

Will they get them?

Not if an alleged conspiracy of intimidation and enforced silence wins.

Arizona State Rifle and Pistol Association President Noble Hathaway said it angers Arizonans that it looks like the federal officials involved with Fast and Furious “got away with it.”

“To Arizonan’s it looks like they all got promotions and were commended for executing this scheme. I hope I am wrong but that is the appearance it had,” Hathaway said.

“By having the top people in management saying they did not know about it, this is worse than just saying they made a mistake and moving on. Not many in this administration preach personal responsibility though so it’s par for the course,” he said.

A former U. S. intelligence and State Department security officer who still has connections in the State Department says he knows why “they got away with it.”

The operative, who asked not to be named, said silence is part of the deal.

“It is highly likely that gun shops in Arizona were forced to assist the U. S. government [in] getting the Fast and Furious guns and ammunition out of the country into Mexico,” he said. “As a result, the gun shops don’t dare elucidate in public on this issue.”

He said many of Arizona’s gun shops were intimidated into cooperating with the federal government and now are being intimidated into silence.

“The government intimidation process included a threat to restrict gun shops’ acquisition of these products through stiffer regulations of the products. This was done by executive action,” he said.

There is evidence that the former intelligence operative and security officer’s claims are on target.

A gun shop owner who declined to allow WND to use his name said he believes that the reason the issue has faded from public and that no gun shops will talk to the media is political pressure.

One gun shop owner refused to speak on the record and referred WND to House Committee on Oversight and Government Reform spokeswoman Becca Watkins.

WND contacted several gun shops in the Phoenix and Tucson areas, and all but one declined to be interviewed about the Fast and Furious investigation. Their response was, “We’re not interested.”

Hathaway said he’s aware that other issues have taken center stage in the country, but because Arizonans want answers, he wants the Fast and Furious investigation to remain alive.

“I hope that after all the other government scandals have been resolved that some focus will again be turned to this issue. It’s just one more reason that the U.S. citizen is becoming very distrustful of their government,” Hathaway said.

“In this instance (it’s the government) wanting to keep the honest citizen from owning a certain firearm but giving 2,000 of them to the drug cartels and bandits south of the border. Go figure,” Hathaway said.

One gun shop owner was willing to go on the record. Black Weapons Armory spokesman Tommy Rompel said he believes some firearms dealers refused to talk to the media because they fear the media more than the government.

“My sense is that they’re paranoid about talking to the press. They’re afraid the media will take their words out of context,” Rompel said.

Hathaway said even though Fast and Furious it not in the headlines every night, “I believe we Arizonans are still concerned with this.

“I would say we are still vigilant on this matter and have not forgotten this misguided venture by the Justice Department,” Hathaway said.

Hathaway said the people of his state have a practical reason to be concerned.

“We are the ones most likely to be killed by this bad element south of our borders which had so many guns put in their hands by the U.S.,” Hathaway said.

He said he doesn’t believe the sales to Mexican crime rings are continuing.

“Every dealer I knew and do know was and is very conscious of not putting firearms in the hands of drug dealers and other vermin,” he said. But the drug dealers now already have the guns.

He said, “We want good citizens to be armed and our families protected from these violent people operating in and out of our state.”
