How long before an over zealous prosecutor tries to

prosecute the clerk for having a gun?

A Chicago store clerk refused to be a victim yesterday evening.

According to a Chicago Tribune article, 25-year-old Demarcus Brandon tried to rob a cell phone shop using a firearm sometime after 6pm yesterday.

The clerk, also armed, got into a gunfight with the suspect, which resulted in the suspect being shot and killed.

A bystander broke his ankle trying to escape the store. It is unclear if the clerk was injured.

Brandon had a criminal record for violent crime and was just recently paroled after serving only 20 months of a 13 year sentence.

According to the Tribune,

The 13-year sentence stemmed from an incident in Chicago in which Brandon was charged with armed robbery with a firearm, armed violence, aggravated unlawful use of a weapon, gun possession, aggravated fleeing from police, and having either a rifle with a barrel less than 16 inches or shotgun with a barrel less than 18 inches.

That case, and the one that ended with a 3-year sentence, both ended in plea deals, according to court records. He was credited for about 20 months time served and admitted to IDOC custody in September 2008.

Ladies and gentlemen, we have another case where being a legal gun owner prevents a crime.

January 2, 2013.  The scene is store in Tallahassee, Florida.  Twenty-six year old Lance Tomberlin entered the store with the intent to rob the cash register.  He carried a cattle prod with which he was going to use to threaten the clerk in the store.  When Tomberline brandished the cattle prod, he demanded that the clerk give him the money from the cash register.  When the clerk refused, Tomberline shocked him with the cattle prod several times.

Before you laugh, let me tell you that the electric shock one gets from a cattle prod can be quite painful.  I speak from personal experience.  That’s when the clerk pulled out a handgun and pointed it at the would-be robber.

Tomberline realized that his cattle prod was no match for the handgun so he fled the store.  Another store clerk tried to stop him from leaving, but Tomberline managed to escape, get in his truck and drive away.  By that time, sheriff deputies arrived and stopped his truck, but Tomberline bailed out and ran away on foot.

On Tuesday of this week, Lance Tomberline was arrested by the Leon County Sheriff’s Department and charged with armed robbery and aggravated battery.

Once again I’ll comment that President Obama, Joe Biden and Michael Bloomberg would rather the clerk at the store just stand there, have the crap shocked out of him, give the robber the money and let him get away.  I, for one, applaud the clerk and his actions and wish more clerks had handguns loaded and ready for other Tomberline’s to come their way.
