This is from The Washington Free Beacon.

I say no more refugees from any of the Arab countries.

We need to round-up and immediately Muslims.

Obama administration withholds details as more attacks occur.

Following the discovery of a terrorist cell in Texas allegedly operated by an Iraqi who entered the United States as a refugee, theWashington Free Beacon has learned of an additional 41 individuals who have been implicated in terrorist plots in the United States since 2014, bringing the total number of terrorists discovered since that time to 113, according to information provided by Congressional sources.

Since August, however, the Obama administration has stonewalled Congressional efforts to obtain more detailed immigration histories of these individuals, prompting frustration on Capitol Hill and accusation that the administration is covering up these histories to avoid exposing flaws in the U.S. screening process.

The disclosure of these additional 41 individuals linked to terror operations—many already identified as immigrants, others’ immigration histories shrouded in secrecy—has stoked further concerns about flaws in the U.S. screening process and is likely to prompt further congressional inquiry into Obama administration efforts to withhold details about these suspects, sources said.

As the number of legal immigrants connected to terrorism continues to grow, the Obama administration has sought to quash congressional inquiries and rally its allies behind an effort to fund efforts to boost the number of immigrants and refugees from the Middle East.

Many of these immigrants have been caught by authorities planning terrorist attacks on American soil, while others were found to be involved in efforts to provide funding and material to ISIS, according to an internal list of migrant terrorists codified by congressional sources and viewed by the Free Beacon.

“A growing number of foreign-born terrorists are being identified operating within the United States, and yet the Administration will not provide any information about their immigrant histories,” said one senior congressional source apprised of the issue. “And one can only imagine that for every identified terrorist, there are many more individuals around them who are radicalized, extreme or otherwise detracting from American society in ways beyond the threat of terrorism alone.”

As congressional calls for increased screening methods go mostly ignored, local authorities are dealing with an uptick in terror-related crimes committed by legal immigrants.

On Thursday, the Justice Department accused two Iraqi refugees legally in the U.S. of conspiring to provide support to ISIS.

Omar Faraj Saeed Al Hardan, a 24-year-old Palestinian born Iraqi refugee who had been living in Texas, was charged with aiding ISIS. The man had been granted legal permanent residence in Houston in 2011, though it was later determined that he “swore untruthfully on his formal application when applying to become a naturalized U.S. citizen,” according to the Justice Department.

Aws Mohammed Younis Al-Jayab, also a Palestinian born Iraqi, allegedly “traveled overseas to fight alongside terrorist organizations and lied to U.S. authorities about his activities,” according to the Justice Department

Al-Jayab entered the U.S. as a refugee in 2012 and later travelled back to Syria, where it is believed that he resumed “fighting with various terrorist organizations,” according to the charges.

Late Thursday, a Philadelphia police officer was reportedly ambushed by an assailant sporting “Muslim garb and wearing a mask,” according to local reports.

Additional information viewed by the Free Beacon outlines another 20 previously unknown individuals brought up on similar terrorism-related charges in 2015 alone.

Those who have been charged were legally residing in the U.S. after entering from countries such as Egypt, Uzbekistan, Albania, Pakistan, and Syria, according to information provided by Congressional sources.

“The terrorism-related arrests of two more Iraqi refugees on American soil proves once again our screening process is weak and needs to be updated,” Sen. Mark Kirk (R., Ill,) said in a statement Friday.

With incidents and indictments of this nature continuing to rise, critics of the Obama administration’s immigration policy are expressing concern about a last-minute funding effort in 2015 to fully fund refugee resettlement and visa programs.

These priorities, which were granted full funding as part of a yearly spending bill approved by Congress last year, will permit around 170,000 new migrants from Muslim-majority countries to enter the United States in 2016, according to the Senate’s immigration subcommittee.

“The omnibus gave the green light for the administration to continue this failed immigration policy over the objections of the electorate,” the senior Congressional source quoted above said.

The Senate continues to uncover dozens of cases in which individuals accused of terrorism entered the country legally.

“Preventing and responding to these acts is an effort encompassing thousands of federal agents and attorneys and billions of dollars: In effect, we are voluntarily admitting individuals at risk for terrorism and then, on the back end, trying to stop them from carrying out their violent designs,” Sen. Jeff Sessions (R., Ala.) warned last year as Congress considered the spending bill.

How JFK’s assassination led to a constitutional amendment

This is from the National Constitution Center.

A small glimpse at the history of the 25th Amendment.

President John F. Kennedy’s death on November 22, 1963 traumatized a nation and led a united Congress to make a key constitutional change, in the form of the 25th amendment.

johnsonoath

Kennedy’s assassination created moments of chaos in the federal government that afternoon. Vice President Lyndon Johnson was in the same motorcade as Kennedy, and there were early, erroneous reports that Johnson was also wounded.

As the country came to grips with the assassination, Johnson made sure the moment when he took the oath of office, about two hours after Kennedy’s death, was documented, so the nation knew a constitutional change of office had taken place.

Johnson stood by his wife, Jackie Kennedy and Judge Sarah T. Hughes as he took the oath at Love Field in Dallas in a now-iconic photograph.

But Kennedy’s sudden passing accelerated an argument about a constitutional change that had been in the works in Congress in 1963.

Technically, the Constitution never spelled out how a Vice President would become President if a President died, resigned or was unable to perform the office’s duty.

This oversight became apparent in 1841, when the newly elected President, William Henry Harrison, died about a month after becoming President. Vice President John Tyler, in a bold move, settled the political debate about succession.

There was a debate in Congress about what powers Tyler had and what he should be called (Acting President, President or Vice President). Tyler settled the debate by asking a local judge to administer the presidential oath, and he fought all attempts by his many political foes to treat him as anything but the legitimate President of the United States.

In the following years, presidential successions happened after the deaths of six presidents, and there were two cases where the offices of President and Vice President almost became vacant at the same time. The Tyler Precedent stood fast in these transition periods.

Furthermore, there was no constitutional way to replace a Vice President who had vacated office, or to handle a situation where a President became incapacitated while in office.

By 1963, Congress was debating an attempt to amend the Constitution to clear up all succession matters and add a procedure for dealing with a leader who became unable to perform the office’s duties temporarily or permanently. This became a bigger issue with the realities of the Cold War and with President Dwight Eisenhower’s illnesses in the 1950s.

The influential Senator Estes Kefauver had started the amendment effort during the Eisenhower era, and he renewed it in 1963. Kefauver died in August 1963 after suffering a heart attack on the Senate floor.

With Kennedy’s unexpected death, the need for a clear way to determine presidential succession, especially with the new reality of the Cold War and its frightening technologies, forced Congress into action.

The new President, Lyndon Johnson, had known health issues, and the next two people in line for the presidency were 71-year-old John McCormack (the Speaker of the House) and Senate Pro Tempore Carl Hayden, who was 86 years old.

Senator Birch Bayh had replaced Kefauver on the Senate subcommittee that considered constitutional amendments, and he tried to get a version of the Kefauver amendment approved in Congress in 1964, after Kennedy’s death. That first effort failed, but Kefauver, with President Lyndon Johnson’s support, proposed it again right after Johnson’s inauguration in January 1965.

Within three months, the House and the Senate agreed on the wording of what would become the 25th Amendment, and in July 1965, Nebraska became the first state to ratify the proposed amendment. Nevada was the 38th state to ratify the amendment, in February 1967, making it the law of the land.

Section 1 of the 25th Amendment made it clear that the Vice President became President when the presidency became vacant under three circumstances: death, resignation and removal from office.

Section 2 gave the President the power to name a new Vice President, if that office became vacant, with the permission of Congress.

The amendment’s other two sections detail the process for the Vice President to serve as Acting President if the President was unable to perform his or her official duties, and how to resolve disputes about the President’s ability to discharge official powers.

The 25th Amendment would receive its first test in October 1973, when Vice President Spiro Agnew resigned. Gerald Ford became the new Vice President in December 1973, after President Richard Nixon nominated Ford for congressional approval.

Ford himself invoked the 25th Amendment nine months later, when he nominated Nelson Rockefeller as Vice President, after Nixon’s resignation.

6 Reasons Why Obama Is Asking Permission To Fight ISIS Even Though He’s Already Fighting Them

This is from Independent Journal Review.

I think the main reason Obama has gone hat in hand to Congress asking permission to fight ISIS is he knows his plan is a cluster fu@k.

By asking Congress to give him the authorization to fight ISIS when things go to Hell he can blame Congress.

For months now, President Obama has pushed for his war plans against the Islamic State of Iraq and al-Sham (ISIS) by citing the Authorization to Use Military Force (AUMF) former President Bush put in place after the 9/11 attacks. Obama made it clear he did not need Congress to approvehis actions.

So, why is he suddenly asking permission from Congress? That’s the question making its way around the media this week, as Obama sent in a formal request for a new AUMF.

1. There are differing opinions on his reasoning, with some–like NPR’s Mara Liasson–arguing the President simply wants Congress behind him:

“Well, the president said he doesn’t need permission from Congress, that he has enough authorities in his power as commander-in-chief and because of a 2002 authorization to use military force – AUMF. But he says the U.S. is always stronger when it acts militarily if it has buy-in from Congress. And, of course, Congress has been asking the president to send them an authorization.”

2. According to Fox News:

“The White House insists it already has the authority to launch airstrikes against ISIS militants in Iraq and Syria, as the U.S. has been doing for months, but wants Congress to sign off in order to demonstrate American unity.”

3. Others, like Huffington Post‘s Jen Bendery, claim the new AUMF would give Congress a chance to look good on this issue:

“Congress is in this place where, as one senator told me this week, they like to beat their chests and say ‘We’re the ones who control war authorization. It’s the constitutional right of Congress to do this. We’re the ones. We have the power. But…we don’t really want to do it. So, Obama did this. This is Obama’s war.’”

4. Some argue that Obama needs to ask Congress for permission because of the difference between drone strikes and more traditional military force. NBC reports:

“His proposed authorization would last for three years and would have no geographical limitations. It also calls for flexibility for limited ground operations by the U.S. military, but rules out a longstanding ground force.”

5. The Washington quotes Republican Senator Bob Corker of Tennessee. He believes Obama’s request isn’t sincere, but rather a way to shift blame after a failure of leadership on the part of the President:

“The reason we’re here is a total failure of the president to lead on this issue.”

6. It’s interesting to note Obama’s quick shift in tone over the past year. In January 2014, the President called ISIS the “JV team” of radical Islam. In his letter to Congress last week, Obama takes the terrorist organization much more seriously:

“If left unchecked, ISIL will pose a threat beyond the Middle East, including to the United States homeland.”

The reasons for Obama’s change in position are up for debate, but the threat of ISIS is not. Recent polls show that more than half of Americans (54 percent) support the President’s proposal.

Flashback Friday: Reagan’s Response to Terrorism Stands In STRONG Contrast to Obama’s

This is from Independent Journal Review.

Ronald Reagan was a true leader and an inspiration.

Barack Obama is a limp wristed Nancy boy.

Both President Reagan and President Obama had to deal with terrorist actions during their time in office, but their responses couldn’t be more different.

After ISIS beheaded several American citizens last summer, Obama said in a press conference:

I have consulted in Congress throughout this process. As our strategy develops we will continue to consult with Congress. But I don’t want to put the cart before the horse. We don’t have a strategy yet.

On April 14, 1986, while announcing air and naval strikes against Muammar al-Qaddafi and the Libyan regime, Reagan was emphatic in his resolve to eliminate any terrorist threat.

Colonel Qadaffi is not only an enemy against the United States….He has sanctioned acts of terror in Africa, Europe, and the Middle East…and for us to ignore by inaction the slaughter of American civilians and American soldiers, whether in nightclubs or in airline terminals, is simply not in the American tradition.

When our citizens are abused or attacked anywhere in the world on direct orders of a hostile regime, we will respond so long as I’m in this Oval Office. Self defense is not only our right; it is our duty. It is the purpose behind the mission undertaken tonight, a mission fully consistent with Article 51 of the United Nations Charter.

He counted on America to be passive. He counted wrong.

There should be no place on earth where terrorists can rest and train and perfect their deadly skills. I meant it. I said that we would act with others if possible to ensure that terrorists have no sanctuary anywhere. Tonight, we have.

The differences don’t end there. The Obama administration has a high bar for what they consider “terrorism,” and the Taliban doesn’t qualify:

The Taliban is an armed insurgency, ISIL is a terrorist group. We don’t make concessions to terrorist groups.

That’s an important distinction to remember since the current President actually negotiated with the Taliban to free suspected military deserter Bowe Bergdahl.

27 Facts That Show How The Middle Class Has Fared Under 6 Years Of Barack Obama

This is from BarbWire.

We all know this whole mess is George W. Bush’s fault and Obama just heard on the news how bad things had gotten.

During his State of the Union speech on Tuesday evening, Barack Obama promised to make life better for middle class families.

Of course he has also promised to do this during all of his other State of the Union addresses, but apparently he still believes that there are people out there that are buying what he is selling.

Each January, he gets up there and tells us how the economy is “turning around” and to believe that much brighter days are right around the corner.  And yet things just continue to get even worse for the middle class.

The numbers that you are about to see will not be included in Obama’s State of the Union speech.  They don’t fit the “narrative” that Obama is trying to sell to the American people.  But all of these statistics are accurate.

They paint a picture of a middle class that is dying.  Yes, the decline of the U.S. middle class is a phenomenon that has been playing out for decades.  But without a doubt, our troubles have accelerated during the Obama years.

When it comes to economics, he is completely and utterly clueless, and the policies that he has implemented are eating away at the foundations of our economy like a cancer.  The following are 27 facts that show how the middle class has fared under 6 years of Barack Obama…

#1 American families in the middle 20 percent of the income scale now earn less money than they did on the day when Barack Obama first entered the White House.

#2 American families in the middle 20 percent of the income scale have a lower net worth than they did on the day when Barack Obama first entered the White House.

#3 According to a Washington Post article published just a few days ago, more than 50 percent of the children in U.S. public schools now come from low income homes.  This is the first time that this has happened in at least 50 years.

#4 According to a Census Bureau report that was recently released, 65 percent of all children in the United States are living in a home that receives some form of aid from the federal government.

#5 In 2008, the total number of business closures exceeded the total number of businesses being created for the first time ever, and that has continued to happen every single year since then.

#6 In 2008, 53 percent of all Americans considered themselves to be “middle class”.  But by 2014, only 44 percent of all Americans still considered themselves to be “middle class”.

#7 In 2008, 25 percent of all Americans in the 18 to 29-year-old age bracket considered themselves to be “lower class”.  But in 2014, an astounding 49 percent of all Americans in that age range considered themselves to be “lower class”.

#8 Traditionally, owning a home has been one of the key indicators that you belong to the middle class.  So what does the fact that the rate of homeownership in America has been falling for seven years in a row say about the Obama years?

#9 According to a survey that was conducted last year, 52 percent of all Americans cannot even afford the house that they are living in right now.

#10 After accounting for inflation, median household income in the United States is 8 percent lower than it was when the last recession started in 2007.

#11 According to one recent survey, 62 percent of all Americans are currently living paycheck to paycheck.

#12 At this point, one out of every three adults in the United States has an unpaid debt that is “in collections“.

#13 When Barack Obama first set foot in the Oval Office, 60.6 percent of all working age Americans had a job.  Today, that number is sitting at only 59.2 percent…

image: http://cdn5.freedomoutpost.com/wp-content/uploads/2015/01/Employment-Population-Ratio-2015.png

Employment-Population-Ratio-2015

#14 While Barack Obama has been in the White House, the average duration of unemployment in the United States has risen from 19.8 weeks to 32.8 weeks.

#15 It is hard to believe, but an astounding 53 percent of all American workers make less than $30,000 a year.

#16 At the end of Barack Obama’s first year in office, our yearly trade deficit with China was 226 billion dollars.  Last year, it was more than 314 billion dollars.

#17 When Barack Obama was first elected, the U.S. debt to GDP ratio was under 70 percent.  Today, it is over 101 percent.

#18 The U.S. national debt is on pace to approximately double during the eight years of the Obama administration.  In other words, under Barack Obama the U.S. government will accumulate about as much debt as it did under all of the other presidents in U.S. history combined.

#19 According to the New York Times, the “typical American household” is now worth 36 percent less than it was worth a decade ago.

#20 The poverty rate in the United States has been at 15 percent or above for 3 consecutive years.  This is the first time that has happened since 1965.

#21 From 2009 through 2013, the U.S. government spent a whopping 3.7 trillion dollars on welfare programs.

#22 While Barack Obama has been in the White House, the number of Americans on food stamps has gone from 32 million to 46 million.

#23 Ten years ago, the number of women in the U.S. that had full-time jobs outnumbered the number of women in the U.S. on food stamps by more than a 2 to 1 margin.  But now the number of women in the U.S. on food stamps actually exceeds the number of women that have full-time jobs.

#24 One recent survey discovered that about 22 percent of all Americans have had to turn to a church food panty for assistance.

#25 An astounding 45 percent of all African-American children in the United States live in areas of “concentrated poverty”.

#26 40.9 percent of all children in the United States that are living with only one parent are living in poverty.

#27 According to a report that was released late last year by the National Center on Family Homelessness, the number of homeless children in the United States has reached a new all-time record high of 2.5 million.

Unfortunately, this is just the beginning.

The incredibly foolish decisions that have been made by Obama, Congress and the Federal Reserve have brought us right to the precipice of another major financial crisis and another crippling economic downturn.

So as bad as the numbers that I just shared with you above are, the truth is that they are nothing compared to what is coming.

We are heading into the greatest economic crisis that any of us have ever seen, and it is going to shock the world.

I hope that you are getting ready.

A 10-step program for constitutional recovery

This is from Personal Liberty.

We must unite to stop this runaway monster known as the federal government.

By now, you’ve likely read plenty about how the Constitution has been twisted to give the federal government power far beyond anything the Founders ever planned. You already know the dangers of an unchecked president, of a Congress that passes bills without reading them, of agencies that do what they want and of judges who believe in precedent over original meaning.

So I won’t waste your time sharing more of the same.

Is the situation hopeless?

Absolutely not.

But in order to actually turn things around, a few sacred cows need to be dealt with. Here are 10 steps you should take right now to set the stage for a dramatic constitutional recovery.

  1. Recognize that massive change will come only through a revolution in thought. John Adams forcefully asserted that the American Revolution was not, in fact, the war for independence. The “real American Revolution,” Adams wrote, was a “radical change in the principles, opinions, sentiments, and affections of the people.”
  2. Take an honest and fearless inventory of the current situation. It’s not just Obamacare that violates the Constitution. It’s almost everything these people do, from telling you what size toilet you can have, to what kind of light bulb you can buy or what kind of plant you can grow and consume in your own backyard. It’s their Federal Reserve, their wars, their executive orders, their regulations, their “national security” and everything in between. Entire agencies — ATF, DEA, TSA and many others — shouldn’t even exist, much less do what they do. Even programs you like, or feel entitled to because they’ve forced you to pay for them for years, are constitutional violations.
  3. Understand that the federal courts are part of the federal government. If a company were suing you, would you hire one of that company’s lawyers to represent you? If you and I had a dispute, would you want my girlfriend Sarah to decide who’s right and who’s wrong? No, federal judges absolutely cannot be impartial when it comes to federal power. Think “rubber stamp.”
  4. Accept that our problems started well before the president took office. Massive violations of the Constitution have been happening under every president in modern times. Replacing one president with another has happened every four to eight years for a long enough time to know that the next president is going to be really bad, too. Guaranteed. And if that guarantee fails, the one after will be awful. Putting your constitutional eggs into one person’s basket ensures only that the Constitution will end up totally smashed.
  5. View both major political parties as an enemy of liberty. No one in his right mind would see Lucky Luciano as a savior to the evils of Al Capone, or vice versa. Maybe you could convince one of your friends to do all the dirty work needed to rise up the ladder of the organization, so one day they would be in a place to reduce the harm it does to you personally. Maybe, but very unlikely. And even if you could, at the end of the day, a mob boss would still run the organization and would have you killed if needed.
  6. Humbly admit that you’ve never cast a vote for federal office that has reduced the power of the federal government. When you “vote the bums out,” you just get new bums. No further explanation necessary.
  7. Admit that the feds will never stop the feds. Thomas Jefferson and James Madison both recognized that if the federal government ever became the sole and exclusive arbiter of the extent of its own power, that power would always grow, regardless of protests, lawsuits or elections. They were right.
  8. Be ready for the long haul. Liberty is not a spectator sport. It takes action, sustained and persistent. It’s time we all get out of our comfort zone, even if that means we risk something. It’s for the future, and it’s worth it. We all need to be ready to do far more than what we are doing today. That includes committing to doing so incessantly until the job is done.
  9. One step at a time. Without being fully on board with these first nine steps, the 10th will almost certainly end in failure. You might find yourself distracted by the same old tricks they’ve played on all of us for decades (think Bush versus Clinton).
  10. Be entirely ready to take a new approach to stopping the federal government. You are facing a federal government that lies to you, spies on you and claims the power to lock you up “indefinitely” (that means forever) without any due process. They rip you off at every turn and give your money to the politically connected. They make up the rules as they go, and change them on a whim. They have absolutely no respect for the constitution or your liberty.

They mean business. And that means you need to mean business, too.

These people get away with this stuff only as long as you to use their approved methods to stop them from oppressing you.

Madison, known as the “Father of the Constitution,” told us <a “nofollow”=”” href=”http://personalliberty.com/james-madison-stop-federal-government/” target=”_blank”>just what to do. There isn’t a person alive today who knows more about the Constitution than he did, so his advice needs to be followed. Now.

When enough people put Madison’s advice into practice, there’s not much that the federal government can do to force their unconstitutional acts, regulations and mandates down our throats.

Are you in?

BREAKING: New GOP Congress Delivers Some EPIC Bad News to Michelle’s Lunch Rules

This is from Conservative Tribune.

While there are bigger problems facing Congress I applaud them for getting Moochelle out of school lunches.

This could turn into the most epic food fight of all time.

The new GOP-controlled 114th Congress may make repealing Michelle Obama’s signature Healthy Hunger-Free Kids Act one of their first priorities when they take control of both chambers of the legislature in January.

And while I’d be among the first to argue that Congress has other issues in front of it that should take priority over school lunches, I’ll also loudly applaud any effort to rein in the ridiculous and unconstitutional federal overreach that has become an epidemic under President Barack Obama.

That includes Michille Obama’s attempt to address childhood obesity through federal regulation of what children can buy and eat on school property.

Opposition to the new program has grown as it took full effect this school year. Students have launched social media campaigns deriding the tiny portions, tasteless offerings and lack of variety.

Many school districts have withdrawn from the program, abandoning the federal funds that come with it, because students refuse to purchase the unappetizing lunches or throw them away.

Some schools in poorer areas where students have less choice have been forced to remain in the program — meaning that poor students, who rely more than anyone else on school lunches for nutrition and calories, are going hungry under the first lady’s guidelines.

The School Nutrition Association, a lobbying group that once approved the program, has reversed its position in light of the enormous costs and waste associated with it, according to Newsmax.

As usual, while Democrats will continue to give lip service to taking care of the poor, it will require Republican control of Congress to actually do anything about it.

The real question for the conservatives will be whether the GOP axes the program completely and returns control of nutritional standards to states, communities and parents — where it belongs — or replaces it with some other example of federal overreach that merely relaxes the standards but leaves them in federal hands.

Voters will be watching.

Pelosi Asks Dems To “Stand With Her And Fight Against The Tea Party”…

This is from Weasel Zippers.

San Fran Nan has some serious brain damage.

I think most Democrats want to steer clear of Pelosi,Reed etc.

If it wasn’t for Nancy Pelosi this country would have been overrun by Tea Party terrorists a long time ago.

Dear Drew,

This was a tough November, there’s no doubt about it. The Tea Party has even more allies in Congress.

But we cannot be defeated. It is more important now — maybe more important than it’s ever been — that we stand with Nancy in the fight for middle class families.

Will you sign on to stand with Nancy and fight against the Tea Party?

The Tea Party is almost certain to ram through the Ryan Plan to end Medicare as we know it. They could try to privatize Social Security or restrict women’s access to health care.

Everything we’ve fought so long to achieve is still on the line.

Nancy will not sit by and watch the Tea Party chip away at America’s middle class. She is running to be the Democratic Leader in the 114th Congress so she can continue to fight for our families and our future.

She needs each and every one of us with her.

Stand with Nancy in support of middle class families and values. Sign on today.

Thank you.

Trey Gowdy Erupts During House Floor Speech Aimed at Dems Making Excuses for Ex-IRS Official Lois Lerner

This is from The Blaze.

You can bet Trey Gowdy(R-SC) will be in the DemocRats cross hairs hoping to defeat him in November.

https://www.youtube.com/watch?v=adHePRrqCjU

Speaking on the House floor Thursday, Rep. Trey Gowdy (R-S.C.) lost his patience with Democrats who are making excuses about why ex-IRS official Lois Lerner shouldn’t have to testify before Congress about the agency’s targeting scandal.

(AP Photo/Pablo Martinez Monsivais)

While some Democrats argue she isn’t required to testify because she’s invoked her Fifth Amendment right to remain silent, Gowdy explained why she has waived those rights in an impassioned floor speech.

“Mr. Chairman, I counted 17 separate factual assertions by Mrs. Lerner — not those three little sentences that my colleagues like to cite,” Gowdy said. “That is a lot of talking for someone who wants to remain silent! That’s a lot of talking! If you honestly believe you can make 17 separate factual assertions and still invoke your right to remain silent, then please tell me what waiver is.”

He pointed out that Lerner testified that she had broken no rules or laws during her time at the IRS, which he claims is problematic by itself in regards to the law.

“Can you imagine a fact pattern where somebody takes the stand and says, ‘I didn’t rob the bank. But I’m not gonna answer why my fingerprints are on the demand note,’” Gowdy continued. “‘And I’m not gonna tell you why I’m on the surveillance footage with a gun in my hand. And I’m not gonna tell you why the dye pack blew up in my car. I’m just gonna tell you I didn’t rob the bank!’ That’s not the way our system works.”

Issa to ATF Head: Why Are Major Fast and Furious Players Still Working at the Agency?

This is from Town Hall.

Part of the reason nobody has been fired is a major case of CYA.

They can not piss anyone off by firing them keep them employed their voices will be silenced forever

Late yesterday afternoon, Chairman of the House Oversight Committee Darrell Issa and Ranking Member of the Senate Judiciary Committee Chuck Grassley sent a letter to ATF Chief B. Todd Jones asking why major players in Operation Fast and Furious are still working at the agency, especially considering Jones said they were no longer employed. Although many agents and supervisors involved in the deadly operation have retired or resigned since 2010 when Border Patrol Agent Brian Terry was killed with a gun trafficked to Mexican cartels during the program, not a single person has been fired.

“The family of Border Patrol Agent Brian Terry, who lost his life in the line of duty on December 15, 2010, recently contacted our staffs. The Terry family wanted to know why, more than three years after Agent Terry’s murder, the Bureau of Alcohol, Tobacco, Firearms, and Explosives has not fired anyone because of Agent Terry’s death. As yo you are no doubt aware, weapons from the reckless Operation Fast and Furious were found at the scene of his murder,” the lawmakers wrote. “Although Operation Fast and Furious took place before you became Director of ATF, the disciplinary actions against the ATF agents who designed, conducted, and managed the reckless operation has fallen squarely within your tenure at the head of the agency.”

According to the letter, ATF continues to employ Case Agent Hope MacAllister, Group Supervisor David Voth, and Special Agent in Charge William Newell. All three were major players during Fast and Furious in the Phoenix Field Division. Not only were they involved in the operation, but also retaliated against whistleblowers like John Dodson for speaking out against their tactics. Newell’s corrupt and reckless history in particular goes far beyond Operation Fast and Furious and into cases like Dobyns v. USA.

“It is inexcusable that, 19 months after these findings became public, ATF has provided Congress with no information about whether, or to what extent, these employees have been held accountable. The repeated faulty judgment of MacAllister, Voth, and Newell severely jeopardized public safety during Fast and Furious, and ATF’s failure to account for what disciplinary action, if any, has been taken is an affront to the family of Brian Terry,” the letter continues.

Issa and Grassley also pressed Jones about a recent Inspector General report showing that approval was given to former ATF Agenet Bill McMahon to take a $200,000 per year salary with JPMorgan, the bank that holds ATF credit cards, while at the same time taking paid ATF leave in order to secure his retirement benefits after Fast and Furious fallout. The OIG report described this action as “being fraud” had it not been approved by government supervisors.

Before he was confirmed as permanent director of ATF, Jones promised to clean up the agency. Jones will be testifying tomorrow, Wednesday on Capitol Hill in front of the House Oversight Committee at 9:30 am et. The focus of the hearing will be ATF’s reckless storefront tactics, tactics that include using mentally disabled teens for sting operations, but the questions outlined in this letter are also sure to come up.
