Federal action sought on ‘stand your ground’ laws

A group of congressional Democrats pressed the Justice Department Tuesday to gather new data about the effects of so-called “stand your ground” laws on public safety.

Roughly two dozen states have adopted laws authorizing citizens to use deadly force if threatened, even if they could retreat instead.

The statutes have been the subject of intense debate since volunteer neighborhood watchman George Zimmerman fatally shot 17-year-old Trayvon Martin last year, even though Zimmerman did not rely on Florida’s stand your ground law in his defense.

President Obama and Attorney General Eric Holder have called for reconsideration of the laws and whether they encourage violence.


Echoing those concerns, seven lawmakers issued a letter to Holder Tuesday, asking him to direct the Justice Department to adjust the definition of the term “justifiable homicide” in order to capture all cases involving stand your ground laws.

The group is also seeking data on other variables of such killings, including their location, information about who in the altercation was armed, the kind of weapons used and reasons they were justified.

“We believe this information would prove extremely useful in helping to evaluate the laws that govern the use of lethal force and in quantifying the impact of such laws on public safety and civil rights,” the lawmakers wrote to Holder.

Signatories on the letter were Sens. Dick Durbin (D-Ill.) and Mazie Hirono (D-Hawaii), along with Reps. Elijah Cummings (D-Md.), John Conyers Jr. (D-Mich.), Luis Gutiérrez (D-Ill.), Bobby Scott (D-Va.) and Marcia Fudge (D-Ohio).

The lawmakers are also asking the Justice Department to sponsor research through the National Institute of Justice related to trends in justifiable homicides and state-by-state analyses of the impacts of different variations of “stand your ground” laws.

Durbin, citing existing research, said the laws have led to increased violence.

“But the federal government does not collect adequate data on these laws’ impact,” he said. “That must change.”

While the agency has authority to research the matter, the federal government is largely powerless to stop states from passing or enforcing the laws.

According to the Detroit Free Press, Conyers was seen “nodding in agreement” during Farrakhan’s remarks.

The Anti-Defamation League is criticizing Louis Farrakhan for delivering blatantly anti-Semitic statements, using terms such as “Satanic Jews” and the “Synagogue of Satan,” during a speech at a Detroit church last week. The Jewish group is also asking why public figures who attended the Nation of Islam leader’s event have remained silent.

According to the ADL and the Detroit Free Press, those present at the May 17th Fellowship Chapel event included the church’s leader, Rev. Wendell Anthony, who also serves as President of the Detroit branch of the NAACP, Rep. John Conyers (D-Michigan) and Detroit City Councilwoman JoAnn Watson. According to the Detroit Free Press, “Conyers and Watson nodded in agreement during some of Farrakhan’s remarks”; however, the paper did not specify during which parts of the speech they nodded.

On Friday, over 1,000 activists gathered in Dearborn, Michigan, to rally against free speech, protesting an online anti-Islamic video some still claim is the motivation behind protests in the Middle East.

“There is a need for deterrent legal measures against those individuals or groups that want to damage relations between people, spread hate and incite violence,” said organizer Osama Siblani, a publisher for Arab-American News and self-proclaimed “moderate.”

“We firmly reject the actions by those who abuse the universal right of free speech to sow the seeds of hate and discord against the religious beliefs of others,” he added.

Henry Payne wrote at the Detroit News that Siblani “is apparently oblivious to how gutting the First Amendment would affect his own business.”

According to Payne, organizers “seek an international law banning what they define as anti-Mohammed speech that would supersede American law.”

The event comes just days after President Obama told the United Nations General Assembly that the “future must not belong to those who slander the prophet of Islam.”

The Detroit Free Press reported that Friday’s rally was “the third protest in metro Detroit over the movie, the biggest one yet.”
“Say No to Hate-Mongering, Say No to Islamophobia,” said a banner at the Ford Performing Arts & Community Center.

Among those speaking at the event were Rep. John Conyers (D-MI), Wayne County Circuit Court Judge Richard Halloran, and civil rights leaders like Donnell White, executive director of the Detroit branch of the NAACP.

United we stand, divided we fall,” White said. “We stand with you as our brothers and sisters.”
“We need to speak out against discrimination against Islam,” Judge Halloran said.

Payne notes that the rally “comes at a time when hate crimes toward Muslims in America have dropped more 50 percent in a decade.”

Another rally is scheduled to take place on Saturday, the Free Press reported.
