HUNTSVILLE, TEXAS –  A Mexican national was executed Wednesday night in Texas for killing a Houston police officer, despite pleas and diplomatic pressure from the Mexican government and the U.S. State Department to halt the punishment.

Edgar Tamayo, 46, received a lethal injection for the January 1994 fatal shooting of Officer Guy Gaddis, 24.

Asked by a warden if he had a final statement, he mumbled “no” and shook his head. As the lethal dose of pentobarbital began taking effect, he took a few breaths and then made one slightly audible snore before all movement stopped. He was pronounced dead 17 minutes after the drug was administered, at 9:32 p.m. CST.

Tamayo never looked toward Gaddis’ mother, two brothers and two other relatives who watched through a window. He selected no witnesses of his own.

There were several dozen police officers and supporters of the slain patrolman were revving their motorcycles outside of the prison before witnesses were let inside the death chamber.

The execution, the first this year in the nation’s most active death penalty state, came after the U.S. Supreme Court and lower federal courts rejected last-day appeals and Texas officials spurned arguments that Tamayo’s case was tainted because he wasn’t informed, under an international agreement, that he could get legal help from the Mexican consulate after his arrest for the officer’s slaying.

Attorneys had also argued unsuccessfully that Tamayo was mentally impaired, making him ineligible for execution, and that the state’s clemency procedures were unfair.

The Texas Board of Pardons and Paroles on Tuesday had rejected Tamayo’s request for clemency.

“It doesn’t matter where you’re from,” said Lucy Nashed, spokeswoman for Gov. Rick Perry. “If you commit a despicable crime like this in Texas, you are subject to our state laws, including a fair trial by jury and the ultimate penalty.”

Tamayo’s lawyers, Sandra L. Babcock and Maurie Levin, issued a statement after the Supreme Court’s ruling, saying Perry and Attorney General Greg Abbott “ignored promises they made to our nation’s leaders that they would ensure review of Mr. Tamayo’s consular rights violation.”

“The execution of Mr. Tamayo violates the United States’ treaty commitments, threatens the nation’s foreign policy interests, and undermines the safety of all Americans abroad,” Babcock and Levin also said.

Gaddis, who had been on the force for two years, was driving Tamayo and another man from a robbery scene when evidence showed the officer was shot three times in the head and neck with a pistol Tamayo had concealed in his pants. The car crashed, and Tamayo fled on foot but was captured a few blocks away, still in handcuffs, carrying the robbery victim’s watch and wearing the victim’s necklace.

Mexican officials and Tamayo’s attorneys contend he was protected under a provision of the 1963 Vienna Convention on Consular Relations. Legal assistance guaranteed under that treaty could have uncovered evidence to contest the capital murder charge or provide evidence to keep Tamayo off death row, they said.

Records show the consulate became involved or aware of the case just as his trial was to begin.

Secretary of State John Kerry previously asked Abbott to delay Tamayo’s punishment, saying it “could impact the way American citizens are treated in other countries.” The State Department repeated that stance Wednesday.

But Abbott’s office and the Harris County district attorney opposed any delays.

At least two other inmates in circumstances similar to Tamayo’s were executed in Texas in recent years.

The Mexican government said in a statement after Tamayo’s death that what’s important in this case is “the respect for the right of access to protection provided by our consulates to Mexicans abroad.” Earlier this week, it said it “strongly opposed” the execution.

Tamayo was in the U.S. illegally and had a criminal record in California, where he had served time for robbery and was paroled, according to prison records.

Tamayo was among more than four dozen Mexican nationals awaiting execution in the U.S. when the International Court of Justice in The Hague, Netherlands, ruled in 2004 they hadn’t been advised properly of their consular rights. The Supreme Court subsequently said hearings urged by the international court in those inmates’ cases could be mandated only if Congress implemented legislation to do so.

“Unfortunately, this legislation has not been adopted,” the Mexican foreign ministry acknowledged.


Sheila Jackson Lee Wants to Revamp Welfare’s Image

On behalf of those who want to gussy-up bad social policy with fancy words, Sheila Jackson Lee (D-Texas), the woman known for her famous braids and multi-colored pashminas, is proposing the term “welfare” be changed to “transitional living fund.”

Wait! Does Sheila mean “transitional” like in transitioning from one welfare check to another welfare check for 50 years, or another kind of transitional?

While waiting for the answer, and before agreeing that the name change is a good idea, maybe we should revisit some of Sheila’s other stupefying statements.

The Texas congresswoman is the person who, when pontificating on the House floor about America winning a war we did not win, actually said that there are two Vietnams.

From geographical knowledge to astronomical appreciation to Ku Klux Klan identification, Ms. Lee also said that Neil Armstrong landed on Mars.  And that “All those who wore sheets a long time ago have now lifted them off and started wearing… uh, clothing, uh, with a name, say, I am part of the tea party.”

Recently, during the government shutdown, Sheila offered the mind-boggling suggestion that martial law is a means to reopening government.

Now, embroiled in the unemployment insurance to-do, Lee took to the House floor again. This time to honor the 50th anniversary of LBJ’s abysmal failure called the War on Poverty which, unlike the War on Terror, Sheila was willing to call by name.

Sans those trademark braids, Sheila offered the following poignant plea about the war on poverty:

“Mr. Speaker, and I ask us not to give up the fight because the American people are looking to us to win the war.”

Placing her stamp of approval on government welfare programs and without explaining what she meant when she said it, Ms. Lee said the “safety net has to be something for all of us.”

The congresswoman extolled the Earned Income Credit and food and nutrition programs which currently have 47 million Americans receiving benefits. Lee mentioned jobs training and education programs, Medicaid, Medicare, and the Affordable Care Act, describing them as “huge safety nets — not handouts, but safety nets.”

“Quite frankly,” Congresswoman Lee said, “of all the wealthy nations, we have the lowest safety net and the highest poverty, because we’re not willing to accept the fact that sometimes an American needs help. Even a veteran — even a soldier.”

Sheila brought along visual teaching tools. To drive home the need for unemployment insurance, she exhibited a picture of people standing in a very long line.

Although unsure herself of what they were even standing in line for, which could have just as easily been Billy Joel concert tickets, Ms. Lee shared that the people could “possibly be looking for work.”

Yes, or lining up outside an Apple store for a new iPhone, or waiting for Walmart to open their doors on Black Friday.

Jackson-Lee did admit that by merely looking at the picture there is no way to know which, if any, of the people in the photograph “are near the edge of poverty or living in poverty simply because they cannot find work.”

Finally, Sheila Jackson-Lee used her persuasive gift of rhetoric to press Congress to extend provisional benefits in the form of a “transitional outreach to individuals who are chronically unemployed.”  An unemployed thanks to the president she insists on hugging in the aisle at every State of the Union address.

The Left’s coined the term “man-caused disaster” for terrorism, and changed the image.

Now Ms. Lee is convinced that with a clever name change, the stigma associated with chronically requesting government assistance can be banished from America’s consciousness forever.

Kaiserhof owner Michael De Beyer told KHOU-TV that he felt a moral imperative to help 19-year-old waitress Brittany Mathis pay the medical bills piling up around her.

“I just can’t be standing by and doing nothing,” he said. “I have to try something because it’s not right.”

Doctors first discovered that Mathis had a brain tumor after she had noticed a rash on her leg.

“I went to the hospital and found out it was my blood clotting,” Mathis said. “So, they wanted to keep me and do CAT scans and MRIs and the next day they came in and told me I had a tumor.”

The 19-year-old doesn’t have insurance and reportedly can’t even afford to learn whether her tumor is benign or malignant.

So her boss has decided to sell his 6,000 square foot restaurant to help. He told KHOU-TV he will donate the money to Mathis.

“I really think it’s an amazing blessing and can’t thank him enough and his family,” Mathis said. “Never thought that anybody would do that and he did and it makes me feel really good.”

Apparently the gun haters have decided that since they can’t convince business owners to post anti-gun signs, maybe they should post the signs themselves.

After Oct 1st I started to look for posted signs at my favorite establishments. I frequently go to a local chicken wing place in Greensboro and last week I noticed a simple sicker that pictured a pistol with red circle and line through it. I took it as no firearms allowed.

I was grabbing a to go order so I had already called it in. I was sad as this was going to be my last order as I wasn’t going to support them anymore. I REALLY like their wings. The manager is the one who brought me my order and gave me the customary “come again soon.” To which I replied “not likely as long as you have that” pointing at the sticker.

She was shocked and asked the hostess if she knew who put that there. She asked me to wait and went to the back. She came back with the chef who is the owner and he said he had no idea how that got there. He removed it and wished me a good day.

The story has a happy ending, but the follow up is even better.

Yesterday, I went back and the manager said she looked at the surveillance video and said late one night a customer put the sticker there just before closing on their way out. They confronted them as they are also a frequent customer. She stated that she does that all over town where ever she goes. The manager asked them not to come back anymore.

There’s a lesson here. If you see a gun ban sign, make sure to question it. It might be some anti-gun jerk posting the sign.

UPDATE: Given that lots of people are coming in via Instapundit (Thanks for the link, Glenn!) it’s possible that many of you don’t know North Carolina law. In NC, any No Guns sign has the force of law. There is not standard mandated sign, like Texas’ 30.06 sign. Passing a “No Guns” sign while carrying a gun on a CHP is a Class 1 Misdemeanor.

Representative Sheila Jackson Lee, a Texas Democrat, told National Review Online today that instead of sending out cancellation letters, insurance companies should have told their customers that their coverage was about to get better.

She said she wrote an amendment before the president’s announcement that would require insurance companies to “tell the truth.”

“The cancellation notice was not the truth,” she says. “It should have been: ’We intend to or expect to modify your insurance.’”

Really, Rep. Lee? Really? How else could you possibly describe a letter from an insurance company that blatantly states that their plan will no longer be offereddue to Obamacare? It is, in the literal sense of the word, a cancellation letter.

Why Republican Leaders Joined Obama in Attacking Cruz and Tea Party

It is time to put up Tea Party candidates to make these

RINO‘s extinct.


These three men are the problem not the solution.


The finger pointing and savaging of the Tea Party and Texas U.S. Senator Ted Cruz began weeks ago and it has been unrelenting. Many in the senate had been laying in wait all through the summer as Senator Cruz traveled the nation calling attention to Obamacare and its potentially devastating impact on Americans and their families.

Instead of locking arms in solidarity many of the Republicans in the mainstream joined the liberal pundits and President Barrack Obama in undermining the very facts that Cruz and other Tea Party leaders had been presenting. The Obama scare machine was in full effect and much of its fuel was supplied by so-called Republican lawmakers like Senator John McCain and Lindsey Graham. These beltway insiders were attempting to deal Cruz and the Tea Party a fatal knockout punch after Cruz’s twenty-one hour senate filibuster.

When the president recently refused to negotiate over the shutting down of the government which he and his senate bagman Majority Leader Harry Reed of Nevada had engineered, Republican pundits attempted to tar and feather the freshman senator from Texas.

What seemed clear to even the most moronic liberal attackers and the mainstream media henchmen was they had to do precious little to undermine Cruz. Instead, they let Republican RINO spokesmen do the hatchet work on the Tea Party and its Congressional Caucus in the House.

With each day of the government shut down came the renewed howls from Congressional republicans like Congressman Pete King of New York, who decried the principled position taken by Tea Party loyalists. King vilified their efforts, but saved his strongest verbal barrage for Ted Cruz, whom he would have all of America believe was evil incarnate.

Of course, this type of congressional behavior is to be expected and is certainly not new to either chamber on Capitol Hill. The stakes for the control of the Republican Party have shifted since 2010, and Congressman King and others want to wrench it back. When the Tea Party revolution carried sixty-four new congressmen to the House and gave Republicans the majority and John Boehner the Speakership the moderate Republican leadership did not welcome the change.

Since that time, Tea Party elected officials in the congress have left comfortable Republican lawmakers with the “unenviable job” of actually doing the job they were elected to fulfill. Tea Party lawmakers focused attention on controlling the growth of government and focusing attention on the exploding seventeen trillion dollar U.S. deficit. Business as usual was over and RINO congressmen hated it.

Then from Texas, came a new target for the liberals, the White House and the RINOs to eviscerate, since they had done the same to Sarah Palin. Ted Cruz came to Washington, D.C. with an agenda which was as large as Texas and as important as the signing of the Declaration of Independence. Cruz was putting the deal making cronies of Capitol Hill on notice that the power belongs to the citizens of this nation and they wanted that power back!

The liberals and Republi-crats of the congress just waited their time and hoped that Cruz and his senate Tea Party companions Mike Lee of Utah and Rand Paul of Kentucky would simply melt into the abyss of senate parliamentarian rules. But unlike the senators of lesser principles, they decided to chart a different course.

They exposed to the nation the utter hypocrisy of the new Obamacare legislation and how the president had, time after time, given his supporters relief from the health care law’s severe conditions. The Tea party backed senators were quite clear: if ordinary Americans had to be afflicted with this onerous bill and its conditions, then congress, the president and all those friends of Obama’s had to suffer along with them. In America there are no ruling classes that are allowed exemptions while others suffer under the oppressive weight of this law.

The president dodged the hypocrisy and the RINOs looked the other way while the mainstream media continued to savage the Tea Party senate trio through the summer months into the fall.

So now, after a little over two weeks of Capitol Games playing where the Republicans in the House voted time after time to reopen the government, and the senate and the president rejected those overtures, America suffered.

Will this compromise mean anything to the American people? Probably not, because in large part they may not have even noticed that the government was partially shut down except for Obama’s barricading of national monuments like the World War II Memorial, where he intended to make veterans feel the pain.

The winners can be said to be the Tea Party, and perhaps not in the way that the liberal and RINO congressional leaders and their sycophant pundits believe. The Tea Party Caucus in the House stood together and fired up a base out in the heartland of the nation that is growing steadily.

The RINOs in congress and their mainstream Republican apologists are at a crossroads in the history of this nation. Their way of cultivating contempt for bonafide leaders from the heartland is not working. Ted Cruz, Mike Lee and House Tea Party leaders are not backing down or backing away from the reason they were sent to congress.

On Wednesday Senator Cruz told the nation he was not giving up the fight, and stressed, “”Unfortunately, once again, it appears the Washington establishment is refusing to listen to the American people,” Cruz said.”The deal that has been cut provides no relief to the millions of Americans who are hurting because of Obamacare …. It provides no relief to all the single parents who have been forced into part-time work, struggling to feed their kids on twenty-nine hours a week.”

While the liberal and RINO pundits are trying to convince Americans that the nation dodged a fiscal bullet from going over the cliff, in reality, in ninety days or less, a stronger, more energized Tea Party at the grassroots will be targeting those RINO senators and house members that vilified conservative principled leaders.

The war for America’s soul is real and the line has been drawn between retaining a ship of fools in the congress or sending a battleship of Tea Party leaders to replace them in 2014. You make the decision!


Cruz: ‘I don’t work for the party bosses’

Sen. Ted Cruz (R-Texas) is standing firm in his fight against ObamaCare, undeterred by party elders and poll numbers that suggest his unflinching crusade against the president’s signature legislative accomplishment has badly bruised the Republican Party’s national brand.

The Texas senator was the unquestioned focus of Sunday morning’s talk shows, sitting for a pair of interviews himself and providing fodder for nearly every lawmaker interviewed.


Echoing the determination he voiced in Senate hallways and in secret meetings with House Republicans throughout the shutdown, Cruz said he was “not remotely” upset that party leaders had chastised him over a legislative strategy many believe forced the 16-day government shutdown.

He said he would “continue to do anything I can to stop the train wreck that is ObamaCare,” hinting that he could again seek to complicate efforts to pass a long-term budget deal.

“I don’t work for the party bosses in Washington. I work for the people of Texas, and I fight for them,” Cruz told CNN’s “State of the Union.”

“Look, the reason people are frustrated all over the country is that far too many people get elected and they think they’re there to be part of the club,” he continued.

The Texas senator’s isolation from that club was dramatically apparent on Sunday.

Sen. John McCain said Cruz “went on a fool’s errand” and predicted that popular opinion would prevent Cruz from forcing another shutdown.

“I think he can exercise his rights as a senator, but it will not happen,” McCain told CNN’s “State of the Union.” “The American people will not stand for another one of these things.”

Senate Minority Leader Mitch McConnell (R-Ky.) made clear during his interview with CBS’ “Face the Nation” that his only interest was moving forward from the failed attempt to undermine ObamaCare.

“There will not be another government shutdown. You can count on that,” McConnell said. “Shutting down the government, in my view, is not conservative policy.”

The problem for the GOP is that dyed-in-the-wool conservatives disagree. A Pew Research poll released last week showed Cruz with a 74 to 8 percent approval rating among Tea Party Republicans.

That number falls to 56 to 44 percent among all Republicans, and the same poll shows the Tea Party’s popularity at record lows. Since the shutdown, those with an unfavorable opinion of the conservative movement have ticked up 4 percentage points to 49 percent. The Tea Party’s favorability has dropped from 37 percent in June to 30 percent today.

Cruz says that his colleagues’ willingness to accept ObamaCare as the status quo was the reason that their poll numbers have eroded. Americans want Republicans to stand firm against ObamaCare, he argues. But intraparty divisions have undermined that message.

“There are a lot of politicians in Washington who want to put ObamaCare behind us,” Cruz said. “They want to say, ‘No more. No more discussing ObamaCare.’ The American people are not satisfied with that.”

And he blasted back at his colleagues, insinuating that what they said on television or in town halls differed from what they told him privately.

“What I say privately to my colleagues is the same thing I say publicly,” he said. “And you know what’s interesting? Virtually every person in that room that was criticizing what [Sen.] Mike Lee [(R-Utah)] and I were doing would have said very different things if a camera was in this room. Because what they’re telling their constituents is very different from what they’re saying behind closed doors.”

But Senate veterans say that Cruz is unwilling to accept political realities. With President Obama in the White House until 2017, the GOP would need 67 votes in the Senate to override a veto.

Former Florida Gov. Jeb Bush (R-Fla.) told ABC News it was “a mistake to focus on something that couldn’t be achieved,” saying Cruz needed to display “a little bit of self-restraint.”

And, Bush complained, the controversy over the shutdown had “crowded out” how “dysfunctional” the implementation of ObamaCare had been.

“Frankly, I think the best way to repeal ObamaCare is to have an alternative; we never hear the alternative. We could do this in a much lower cost with improved quality based on our principles, free market principles, And two, show how ObamaCare, flawed to its core, doesn’t work,” Bush said.

Cruz insisted he “profoundly” disagreed with “gray-beards in Washington” who said the GOP would benefit by allowing ObamaCare to collapse under its own weight.

“I consider that theory the ‘Bad Samaritan’ theory. Basically, inflict a bunch of harm on the American people and hope we benefit politically from it. What a terrible, cynical approach.,” Cruz said. “I am not interested in seeing the American people suffer just because my party might benefit politically if they blame the Democrats for the foolish policies that have been imposed.”
